1. Acceptance of Terms
By downloading, accessing, or using Mockingbird ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the App.
2. Description of Service
Mockingbird is a creative tool that allows users to record audio, write notes, and organize musical ideas. The App may provide optional cloud syncing features and data export capabilities.
3. Eligibility
You must be at least 13 years old (or the age of digital consent in your region) to use the App. If you are under 18, you must use the App only with parent or guardian permission.
4. User Content & Ownership
You retain full ownership of all audio recordings, notes, project names, and other creative material you create using the App ("User Content").
You grant Mockingbird a limited, non-exclusive license to store and process User Content solely for the purpose of operating and improving the App—this includes:
- Local storage
- Cloud syncing (if enabled by you)
- Backup and restoration operations
We do not claim ownership over your creative work.
5. Cloud Sync and Storage
If you enable cloud sync:
- Your User Content may be transmitted and stored through third-party services (Supabase)
- Cloud access requires network availability
- Sync performance may vary based on connectivity, device state, or service availability
We are not liable for data loss resulting from:
- Device failure
- Network outages
- Account deletion
- User disabling cloud sync
- Or other circumstances beyond our reasonable control
Users who rely solely on local storage are responsible for exporting their data if they wish to retain it.
6. Subscription Features (If Applicable)
Certain features may require a paid subscription, including multi-device sync and advanced tools. Subscription terms, billing, and cancellation policies are governed by Apple or Google Play.
Features offered in subscriptions may change or evolve over time.
7. Account Deletion and Data Removal
You may delete your account and associated cloud data at any time through the App. Once deleted:
- Your cloud-stored content will be permanently removed
- Local content may also be removed from the device during the deletion process
- This action cannot be undone
You may export your data before deleting your account.
8. Prohibited Conduct
You agree not to:
- Reverse-engineer or attempt to decompile the App
- Use the App to store illegal or harmful content
- Use automated systems to scrape or misuse the service
- Attempt to disrupt or overload our servers or backend providers
9. Intellectual Property & App Content
All Mockingbird branding, UI, code, and design elements are the intellectual property of the developer. You may not:
- Copy, distribute, or commercially exploit the App
- Create derivative works using the App codebase
except where permitted by law.
Nothing in these Terms grants you ownership of Mockingbird's underlying technology.
10. Disclaimer of Warranties
The App is provided "as is" and "as available." We do not guarantee:
- That the App will be error-free
- That sync will always complete
- That your device will not fail
You use the App at your own risk.
11. Limitation of Liability
To the fullest extent permitted by law, Mockingbird and its developer are not liable for:
- Loss of recordings or creative work
- Damages caused by device failure, service outages, misuse, or user error
- Any indirect, incidental, or consequential damages
Our total liability will not exceed the amount you paid for the App during the prior 12 months (including $0 for free users).
12. Changes to the Terms
We may update these Terms from time to time. Continued use of the App signifies acceptance of updated terms.
13. Termination
We reserve the right to suspend or terminate accounts that violate these Terms or misuse the App.
